Mistrial Declared in Merck Case


Two days after the New York jury hearing a case against Merck & Co was given a “cooling off period” a judge has declared a mistrial in the case. The suit was the first to go to trial alleging that the drug Fosamax caused patients to develop osteonecrosis of the jaw. U.S. District Judge John Keenan denied Merck’s attempt earlier this week to dismiss 24 other cases.  Christine Kearney, Grant McCool and Jonathan Stempel, Reuters  09/14/2009
